More reports are surfacing across the nation linking X-LITE guardrail end terminals to deaths and serious injuries. Lawsuits filed against Lindsay Corporation, the manufacturer of X-LITE end terminals, allege the guardrail system has an inherent design flaw that prevents it from telescoping into itself, causing the end terminals to penetrate into vehicles and impale drivers and passengers.

A defective guardrail can be more dangerous than having no guardrail at all. In one especially tragic incident, 37-year-old Sarah Weinberg was killed after she went off Interstate 66 in Tennessee and struck an X-LITE guardrail end terminal almost head on, according to her family’s attorney. She was driving home to visit her family for Christmas.

In another case, Tennessee teenager Hannah Eimers was killed after going off the road, attempting to correct course, and then slamming the driver’s side door into the guardrail end terminal. She died instantly when she was impaled by a metal rail that failed to telescope upon impact, but her passenger walked away with just a small cut.

Thousands of these guardrail systems have been installed across the country, primarily in Virginia, West Virginia, Tennessee, North Carolina, Texas, Maryland, and Massachusetts.

Lindsay Corporation maintains its position that these guardrails have passed inspections but that no test could replicate all possible accident scenarios. Still, the Tennessee Department of Transportation has removed the X-LITE end terminals from its list of qualified products in the wake of mounting evidence that their alleged design flaws caused preventable injuries.

Nobody expects be have their car impaled, and least of all by a highway safety measure intended to protect you in the event of an accident.  However, that is exactly what happened this morning when a Ford Transit work van crashed into the terminal end of a guardrail on Route 6 in West Barnstable, Massachusetts.  Approximately 10 feet of guardrail punctured the vehicle going from the engine compartment through the passenger side seat.

This is just the latest in a long string of cases where guardrails have been found to run through cars instead of crumbling to absorb the shock of an impact.  Guardrail end terminals that predate the National Cooperative Highway Research Program’s Report 350 are especially dangerous and may be considered non-crashworthy, while several personal injury and wrongful death lawsuits have been brought against Trinity Industries for their ET-Plus guardrail.

At this time it is not clear what kind of guardrail system was involved in the accident.

Lawmakers in Tennessee are calling for the U.S. Secretary of Transportation to order a nationwide recall of a controversial guardrail. The Lindsay X-Lite guardrail has played a role in as many as 11 fatal car accidents around the country. Several grieving family members came to Tennessee to support the efforts to recall the guardrail in question. The resolution will head to the governor’s desk for his signature.

Banned and Replaced

Tennessee has lead the charge against Lindsay X-Lite guardrails, with the state’s Department of Transportation banning the installation of the safety devices on their roads. The state also has plans to remove and replace all of the controversial guardrails on their roads by summer 2018. Nearly 2,000 of the Lindsay X-Lites were on Tennessee roads before the removal began.

Design Flaws or Improper Installation

Guardrails are made up of multiple pieces that are designed to slide into each other when struck, also known as “telescoping.” Unfortunately, the Lindsay X-Lite has been known to fail to telescope when it most needs to. Multiple fatal crashes have involved the guardrail failing to collapse under the weight of colliding vehicles. Instead, the metal guardrail pierces the vehicle, slicing through the car and the passengers inside. Victims have suffered from severed limbs, and some have even been impaled by the sharp guardrail pieces.

Some say the Lindsay X-Lite has been improperly designed, while others argue that improper installation is to blame for the malfunction. Regardless, people have lost loved ones because of the X-Lite’s failure to work as intended. We can only hope that this recall is the start of real change.

The victim’s mother said she was shocked to learn that at least seven other people have died in a similar fashion. All eight of the fatal crashes involved the X-LITE end terminal. Five lawsuits have been filed against the manufacturer of the safety device, Lindsay Transportation Solutions, claiming that the guardrail is defective.

Justice for the Victim

Now, the family of the victim is seeking justice for their lost loved one. They hope to raise awareness about the dangers associated with this kind of guardrail end terminal. They also hope to convince Maryland officials to remove and replace the guardrail with something safer. There are more than 900 X-LITE end terminals currently on Maryland roads.

At least ten other states are working to remove the X-LITE from their roads and highways, but Maryland says they have no plans to do so.
