The final results of the Trinity Industries crash tests are in: all eight received passing scores from the Federal Highway Administration. The eight tests utilized guardrails of two different heights, one measuring 27 3/4 inches, one 31 inches.

Critics say the final of the eight tests should have been ruled a failure, as the guardrail severely dented the driver’s side door. Many believe that the Federal Highway Administration has given these test passing grades to cover for the poor job the government did in vetting the material. Some argue that by admitting the guardrails aren’t safe for the road, the administration would be admitting their failure to properly do their jobs. The agency says they will continue to investigate the ET-Plus, as more than 30 states currently have banned the guardrail from future installation.

ABC 13 News Now recently reported that Virginia has not received any application for approval from Trinity Industries to install any more of the ET-Plus guardrails on the Commonwealth’s roads. VDOT, the Virginia Department of Transportation, says more tests will be done to prove the reliability of the ET-Plus. They are also currently accepting bids from companies to remove the problematic guardrails from the roads.

Trinity Industries was fined for defrauding the government by failing to alert regulators to changes in the size of the ET-Plus. A small change in size has reportedly resulted in major product malfunctions, causing severe injuries and even fatalities among crash victims.

Six Senators have penned a letter to the Government Accountability Office seeking an investigation into the Federal Highway Administration. After the controversy surrounding the ET-Plus guardrail and its role on American roads, the policymakers have questioned the FHWA’s approval of the device. The agency also awarded grant money to ensure widespread installation of the ET-Plus. The Senators cited seven specific areas of concern regarding the FHWA.

To start, the letter says, the investigation should look into how the FHWA ensures products are safe. Next, the regulatory process for creating standards should be investigated. The Senators also requested information on how the FHWA develop safety standards and what policies are in place to prevent conflicts of interest from occurring.

32 states have banned the installation of the ET-Plus device following allegations of dangerous device malfunctions. These allegations have resulted in multiple lawsuits against the ET-Plus manufacturer, Trinity Industries. When the device malfunctions, it has been known to lock up and spear colliding vehicles. This piercing effect has injured and killed many. Some have even had limbs amputated by the sharp metal of the guardrail.

The FHWA has responded to the letter, saying they would fully cooperate with the investigation. Considering the ubiquity of the ET-Plus across the United States, it’s incredibly important that the government agency – an agency specifically designed to ensure safe roads for citizens – be investigated. A Texas jury found that Trinity Industries had defrauded the federal government by failing to announce changes made to the design of the ET-Plus. If a change like that can slip past regulators, perhaps an investigation is a good idea indeed.

A Texas judge must soon rule about just how much Trinity Industries will be fined for defrauding the U.S. government. A jury last fall found that the company had deceived regulators about changes made to the design of the ET-Plus guardrail installed along roads and highways across the country. The whistle blower in the case is asking for $709 million in fines and an additional $19 million in lawyer fees.

Bloomberg.com reports that Trinity Industries plans to appeal the decision, but in the meantime, more lawsuits against the company have piled up. Counties in Illinois and Wisconsin, along with a city in Ontario have all filed suit against Trinity. The Canadian suit is seeking damages of $400 million (USD) after the company failed to report potential dangers associated with the ET-Plus.

The guardrail in question has been known to malfunction, piercing vehicles instead of folding backward to stop the accident from speeding off road. This spear-like effect has lead to serious injuries including amputations. Some victims have even died in crashes associated with the ET-Plus. What makes the product especially dangerous is just how many are found in the United States and Canada. Nearly every state has purchased and installed these safety devices on their highways. They remain on roads throughout the country in spite of the allegations of malfunctions. Though dozens of states have banned the future installation of the ET-Plus, thousands of these guardrails are already on our roads, posing an incredible threat to any cars that might come into contact with them.

Plans to remove a potentially deadly highway safety devices from Virginia roads are underway. 13newsnow.com reports that the Virginia Department of Transportation (VDOT) announced these plans via a letter from the state’s chief engineer. The decision comes following controversy associated with the ET-Plus guardrail and its potential malfunction. Accident victims across the country have noted the guardrails tendency to lock up and pierce the cabin of colliding vehicles rather than fold backward to stop the crash as designed.

It’s not known precisely how many ET-Plus guardrails are on roads round Virginia, which is part of what makes the removal process such a challenge. VDOT recently posted a bid requesting the identification and removal process of the ET-Plus guardrails, with all bids due by March. VDOT says, however, they will only award the bid should they indeed choose to move forward on the project.

These baby steps in the right direction may not seem like enough, but Virginia is one of the only states to even begin planning for the removal process. Most states are awaiting the results of a series of crash tests ordered by the federal government. Trinity Industries, the manufacturer of the ET-Plus, conducted these eight tests over the last few months. Only the results of the first four tests have been released thus far, with safety experts expressing concern over the eighth and final test. In that particular test, the driver’s side door was smashed in by the guardrail. Though no official ruling on the test has been made public yet, many speculate that it will receive a failing grade.

The ET-Plus has faced criticism and banning from nearly all 50 of the United States. With malfunction claims against the product stating that it causes more dangerous crash situations, safety experts across the country have been carefully inspecting the guardrail’s role on their state’s highways. Indeed, 46 states have banned the installation of the ET-Plus pending further investigation into the potential malfunction.

North Carolina, however, is one of the four states that have not banned the controversial guardrail. Despite knowledge of six North Carolina ET-Plus crashes – two of which resulted in deaths – the North Carolina Department of Transportation does not feel there is enough evidence to remove the devices from roads. One North Carolina man lost his leg in an accident involving the ET-Plus. He recently told WRAL.com that he still struggles to stand, even with a prothesis. Nationwide, there have been more than 40 deaths and 100 injuries associated with ET-Plus guardrail crashes.

The company behind the ET-Plus, Trinity Industries, insists their product is safe. Trinity is currently conducting a series of federally mandated crash tests to prove the value of their product and to determine the future of its role on our country’s roads. The National Highway Administration announced that the ET-Plus has officially passed four of the eight tests, with other results still pending. If the tests indeed find the guardrail unsafe for our streets, North Carolina and the other three states will have no choice but to ban the use of the ET-Plus.
