Two law firms have announced they will be pursuing civil claims against Trinity Industries. The firms say Trinity’s allegedly defective guardrails are located all across the United States’ highways and roads. One of the firms has said they’ve been in talks with at least 20 people interested in filing claims against the company.

These malfunctioning guardrail heads are located in almost every state in the country. Safety experts believe the guardrails are related to nearly six serious injuries or fatalities per week. This number is shocking, considering the design has been in place for nearly ten years. In 2005, changes were made to the design of the guardrail head and are likely the source of the problem. The design changes went unauthorized and unnoticed for years. Lawyers say evidence from internal Trinity emails show the design changes were made to save the company money – about $2 per guardrail head.

The modified guardrails are known to malfunction when struck by colliding vehicles. Rather than fold backward under the pressure like an accordion, the guardrail head sometimes pierces straight through cars. This has resulted in fatalities, as well victims being severely injured and even losing limbs.

Though many states have announced they’ll stop using Trinity guardrail heads, only Virginia has pledged to get the dangerous ET-Plus model off their roads and highways. Until all the malfunctioning guardrail terminals are pulled from highways across the country, though, it is likely that more accidents will be made worse by the flawed design.
