After a Texas jury issued a $175 award in a lawsuit against Trinity Industries Inc., many states have decided to stop using its guardrail systems.
Nebraska, however, has no plans of doing so just yet. For the time being, the state said it will continue to use the controversial Trinity highway guardrail system until the Federal Highway Administration steps in and says otherwise.
According to the Lincoln Journal Star, Nebraska has been using the ET-Plus guardrail system since 2005.
While many states are doing away with the guardrail system, a spokesperson for the Nebraska Department of Roads said the following:
“They are the experts in the field. But we haven’t seen anything in Nebraska that we have a problem with ET-Plus, but we’re monitoring the situation.”
Trinity Industries Inc. will not sell the guardrail system until additional safety tests are complete. Until then, Nebraska, unlike many states, is not going to place a ban on the product.
