Last week, a Texas jury awarded a Virginia man $175 million in damages in relation to his False Claims Act case against a Texas based guardrail maker.

A spokesperson for the Virginia Department of Transportation said the following:
“In 2005, there was a modification made to that product to a degree that we look at it as a different product. We still need to get the facts and the research and information to make a decision for Virginia’s roads.”

According to the man’s lawsuit, the modifications made by the company, Trinity Industries, Inc., could be fatal. He claims that the cost cutting measures taken by Trinity can turn the head of the guardrails into a spear, giving it the potential to pierce through a vehicle during a collision.

According to the Virginia Department of Transportation, the state has installed 11,000 guardrails since 2006. However, it is unsure as to how many are the ones considered to be dangerous.

The state is currently working with the American Association of State Highway and Federal Highway Association for more information on how to move forward.
