Virginia has moved to the forefront in the fight against a controversial guardrail system, becoming the first state to announce a plan to remove them from the state’s roadways. This decision comes on the heels of the guardrail manufacturer, Trinity Industries, neglecting to meet the deadline for a plan to conduct crash tests for the guardrail.

A spokesperson for the Virginia Department of Transportation told ABC News the following:

Virginia Guardrail Injury Lawyer“The Virginia Department of Transportation is currently putting together a plan for removal.”

Since there is no timeline in place for the removal of the faulty system, the state may still reconsider the idea if Trinity is able to prove, through crash tests, that it is safer than what is currently believed.

The company released a statement saying:

“We do not believe it would be appropriate for any state to remove a product that has met all test previously requested by Federal Highway Administration (FHWA) and continues to remain eligible for federal reimbursement.”

While the state of Virginia may be the first to devise a plan for the removal of the guardrail system, it may not be the last. There are many others considering the same, all of which are aware of the potential risks of leaving the system in place.
